These Terms of Service ("Terms") govern your use of labgrownpro.com (the "Site") and the purchase of products from LabGrownPro ("we", "us", "our"). By accessing the Site or placing an order, you agree to be bound by these Terms.
LabGrownPro is operated under ABN 71 581 861 862, registered address: 42-44 Goenoeng Drive, Tanah Merah QLD 4128, Australia.
1. Acceptance of Terms
By using this Site, you confirm that you:
Are at least 18 years old (or have parental consent)
Have the legal capacity to enter into a binding contract
Accept these Terms in full
2. Australian Consumer Law
The Australian Consumer Law (ACL), contained in the Competition and Consumer Act 2010, provides non-excludable consumer guarantees for all goods and services we supply .
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that you have under the ACL. Our voluntary policies operate in addition to, not in substitution for, your statutory rights.
For goods with a major failure, you are entitled to choose a refund or replacement. For goods with a minor failure, we will repair the goods within a reasonable time.
3. Orders and Acceptance
3.1 All orders placed through the Site are subject to acceptance by us.
3.2 A contract is formed when we accept your order and issue an order confirmation.
3.3 We reserve the right to decline any order at our discretion (e.g., product unavailable, suspected fraud, incorrect pricing).
3.4 For custom, bespoke, and engraved items (including Story Diamond orders), production begins only after a 50% non-refundable deposit is received. Once production has commenced, the order cannot be cancelled.
4. Pricing and Payment
4.1 All prices are listed in AUD and inclusive of 10% GST where applicable to Australian customers .
4.2 For international orders, prices exclude local duties and taxes, which are the customer's responsibility.
4.3 Payment methods accepted: Visa, Mastercard, American Express, PayPal, Apple Pay, Google Pay, Shop Pay, Union Pay, Afterpay.
4.4 Payment must be received in full before production commences (except for custom orders with agreed deposit terms).
4.5 All pricing is displayed inclusive of mandatory fees in accordance with ACL anti-"drip pricing" requirements .
5. Product Description and Accuracy
5.1 We make every effort to display product colours, dimensions, and specifications accurately. However, variations may occur due to:
Natural characteristics of gemstones (each diamond, pearl, and gemstone is unique)
Screen calibration differences
Handcrafted nature of our jewellery
5.2 Product descriptions, including carat weight, colour grade, clarity, and pearl lustre, are provided based on our quality inspection. IGI-certified diamonds include a verifiable certificate number.
6. Delivery and Risk
6.1 Estimated delivery timeframes are set out in our Shipping Policy.
6.2 Risk in the goods passes to you upon delivery to the specified address.
6.3 Ownership passes upon full payment clearance.
6.4 We are not liable for delays caused by customs, courier failures, or force majeure events.
7. Returns, Refunds, and Exchanges
Our full returns policy is set out in the Refund Policy . Summary:
Faulty goods: Full ACL remedies apply (repair, replacement, or refund)
Change of mind: 14-day return window for non-custom items, subject to conditions
Custom/bespoke/engraved items: Not eligible for change-of-mind returns
8. Intellectual Property
8.1 All content on the Site — including text, images, logos, product designs, videos, and graphics — is owned by LabGrownPro or its licensors and is protected by Australian and international IP laws.
8.2 You may not reproduce, distribute, modify, or create derivative works without our prior written consent.
8.3 Our trademarks "LabGrownPro" and associated logos are registered assets.
9. Limitation of Liability
9.1 To the maximum extent permitted by law, our liability for any loss arising from your use of the Site or purchase of products is limited to:
The replacement of goods, or
The repair of goods, or
A refund of the purchase price
9.2 We are not liable for indirect, incidental, or consequential damages, except where such exclusion is prohibited by the ACL.
9.3 Our total aggregate liability shall not exceed the purchase price of the relevant goods.
10. Indemnification
You agree to indemnify and hold harmless LabGrownPro from any claim, loss, damage, or expense arising from your misuse of the Site, violation of these Terms, or infringement of third-party rights.
11. Prohibited Conduct
You must not:
Use the Site for any unlawful purpose
Attempt to gain unauthorised access to our systems
Scrape, harvest, or automate data collection from the Site
Impersonate any person or entity
Interfere with the Site's security or functionality
12. Governing Law and Dispute Resolution
12.1 These Terms are governed by the laws of Queensland, Australia.
12.2 Any dispute shall first be attempted to be resolved through good-faith negotiation.
12.3 If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia.
12.4 Nothing in this clause limits your rights to seek resolution through Queensland Office of Fair Trading or the Australian Competition and Consumer Commission (ACCC).
13. Changes to Terms
We may update these Terms from time to time. The latest version is always available at labgrownpro.com/terms-of-service. Material changes will be notified via email.
